Text For Citation: 01 Item/Group: 001A Hazard:
29 CFR 1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person. Location: Worksite On or about March 11, 2025, employees were exposed to fall hazards of over 20 feet as well as electrical hazards while performing siding activities, where the employer did not ensure that a competent person made frequent and regular inspections of the site. Prior settlement agreements with Lifetime Contractors, Inc. have included requirements for the employer to develop a safety and health management system that incorporated the following elements: management commitment and employee involvement; worksite analysis; hazard prevention and controls; safety and health training. In addition, the employer was required to set up a plan for conducting regular spot checks on jobsites to ensure safety rules were being followed. As per the prior settlement agreements, in consideration of the amendment(s) and/or modification(s) made to the citation(s) for those prior inspections, as well as per required by the OSHA standard, the employer must ensure that a competent person makes frequent and regular inspections of job sites, materials, and equipment. This employer has previously failed to ensure that frequent and regular inspections be performed by a competent person, as seen below: a) Lifetime Contractors Inc. was previously cited for an Other-than-Serious violation of an equivalent occupational safety and health standard, 29 CFR 1926.20(b)(2) which was contained in OSHA inspection number 1703666 citation number 1 item number 1 and was affirmed as a final order on 2/16/2024 with respect to a workplace located at 345 Baker Street, West Roxbury, MA 02132.
