29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) On or about October 17, 2024 - Facility, Abrasive blasting area, an abrasive blaster was exposed to intermittent noise at approximately 9999% of the allowable 8-hour time-weighted average (85 dBA). The equivalent dBA of the employee was approximately 123 dBA. The sampling was performed for 430 minutes during one shift on January 15, 2025. Zero exposure was assumed for the unsampled time of 50 minutes. The employer did not implement a continuing and effective hearing conservation program that included elements such as, but not limited to, a monitoring program, audiometric testing, and employee training. (b) On or about October 17, 2024 - Facility, Abrasive blasting area, an abrasive blaster was exposed to intermittent noise at approximately 7026% of the allowable 8-hour time-weighted average (85 dBA). The equivalent dBA of the employee was approximately 120.7 dBA. The sampling was performed for 464 minutes during one shift on January 15, 2025. Zero exposure was assumed for the unsampled time of 16 minutes. The employer did not implement a continuing and effective hearing conservation program that included elements such as, but not limited to, a monitoring program, audiometric testing, and employee training.
