29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) On or about July 30, 2024, the employer failed to ensure that employees were removed from the hazardous area when the competent person identified the lack of cave-in protection in an excavation exceeding 5 feet in depth. Employees were permitted to continue to work in a 48-foot-long, 6-foot-5-inch-deep excavation to replace water service lines without proper cave-in protection, exposing them to cave-in and struck-by hazards.
