29 CFR 1926.1203(a): Before it began work at a worksite, the employer did not ensure that a competent person identified all confined spaces in which one or more of the employees it directed may have worked, and/or did not identify each space that was a permit space, through consideration and evaluation of the elements of that space, including testing as necessary: On or about July 8, 2024, at job site located at 9220 Old Santa Fe Road, in Kansas City, MO, the employer failed to ensure confined spaces were evaluated by a competent person for characteristics of a permit space that included hazardous atmospheres. The company had a 2-person laborer crew enter active sewer systems via manholes to prep the manhole for invert installation.
