OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, including severe burns, to employees in that the facility, processes, and equipment, including the scrap/dust collection system, were not designed, constructed, equipped, and located, to protect employees from fire and explosion hazards: (a) Main Building - On or about March 12, 2024, the pneumatic system for corrugated scrap and dust collection did not have measures to protect employees from combustible dust fire and explosion hazards, in that: ? The enclosureless dust collector, located inside the building in the baler and shredder area, did not meet all required criteria for an enclosureless dust collector, including, but not limited to, having a maximum air flow capacity not greater than 5,000 cfm, having a location at least 20 ft (6.1 m) from any area routinely occupied by personnel, and getting emptied at least daily. ? Combustible particulate solids and combustible dusts passed through the pneumatic collection system's fans/blowers. ? No magnetic separators or other means existed to prevent tramp metal from entering the pneumatic collection system, including at the floor sweep near the baler. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
