29 CFR 1910.178(n)(4):Industrial truck driver(s) were not required to travel with the load trailing whenever the load obstructed forward view: On or about March 5, 2024, the employer failed to ensure forklift operators traveled in an obstruction free manner. The forklift operator at the Bobcat Farm, located in Benedict, NE operated a Moffitt M4 36.3 to deliver baby chickens to barn number twelve. The standard load consisted of eight stacked crates divided into two rows by four columns. Each column consisted of twelve stacked crates. In total, the 96-crates measured approximately 7-feet in length by-6 feet in height which effectively obscured the operator's vision. This condition resulted in fatal injuries of an employee when he was struck-by and driven over by the Moffitt M4 36.3.
