29 CFR 1910.95(d)(1): When information indicates that any employee's exposure may equal or exceed an 8-hour time-weighted average of 85 decibels, the employer shall develop and implement a monitoring program. On or about February 2, 2024, the employer did not implement an effective noise monitoring program for employees working throughout the facility including but not limited to on and around vibrating tables, the automatic line, using saws such as the Kobalt KWS S102-06, and mixing operations during their 8-hour shifts.
