Text For Citation: 01 Item/Group: 001A Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees due to crushing hazards from being caught-between the forklift's overhead guard and the ground: (a)Protective Coating Specialists, Inc. at 1350 7th Street Northwest, Huron, SD 57350: On or about and at times prior to November 21, 2023, the employer did not ensure an employee operating a Mitsubishi FGC15N liquid propane sit down forklift was protected from crushing hazards resulting from forklift tip over. Abatement Note: Among other methods, one feasible and acceptable abatement method to control this hazard is to follow instructional information provided in the Mitsubishi FGC15N Forklift operator's manual. Page 8 of the manual states; "The seat belt will help restrain you in various accident situations such as a tip over or front-end crash. If you are unrestrained in a tip over, you can fall outside of the operator's compartment and be crushed by the forklift. If you are unrestrained and the forklift comes to a sudden stop, you will continue to move forward until you hit some solid object. You should wear your seatbelt even when operating your forklift from a stationary position or when travelling a short distance." Abatement Note: Among other methods, one feasible and acceptable abatement method to control this hazard is to follow ANSI/ITSDF B56.1-2012, Section 5.3.19, "An active operator protection device or system, when provided, shall be used. Operator protection in the event of tip over is intended to reduce the risk of entrapment of the head and torso between the truck and the ground but may not protect the operator against all possible injury."
