29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: a.) General Partitions Manufacturing Corp., On or about November 20th, 2023 and times prior thereto: Employees voluntarily wore half mask air-purifying respirators (3M brand #6100 series with organic vapor cartridges) during welding/plasma cutting of stainless steel onsite. The company did not establish a worksite specific written respiratory protection program that covered requirements including, but not limited to, medical evaluations for voluntary users of half mask air-purifying respirators (elastomeric). ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
