29 CFR 1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a. a. Mingo's Construction LLC, located at 860 Jaeger Street, Columbus, OH 43206: On or about October 4, 2023, during the construction of a mixed-use (commercial/residential) building, employees were engaged in the rigging of building materials such as OSB sheathing, signaling for a tower crane operator and staging the materials throughout the site. The employer did not develop and maintain accident prevention programs which effectively established, communicated, and enforced work rules for inspecting the condition of rigging materials, verifying that material was rigged to prevent unintentional displacement of a load, cordoning off hoisting routes and/or selecting hoisting routes which minimized employee exposure. The following conditions employees/sub-contractor employees to struck-by hazards from the load being lifted and a subsequent felled load event.
