29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) 1 Orchard Beach Road, Bronx, NY - Orchard Beach Pavilion - South Loggia - Vestibule Ceiling: On or about 7/13/23, two employees performing manual demolition of the ceiling were required to wear N95 respirators and were not provided a medical evaluation to determine their ability to use a respirator. Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
