29 CFR 1910.28(b)(3)(iv): The employer did not provide that each employee be protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toeboards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used. (a) Roof; Condenser units #2 and #3 ladders - On or about June 15, 2023 the ladder used to access the walking/working surface of the condenser units approximately 13 feet high were not guarded at the ladder opening with a self-closing gate or offset. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
