29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) At the facility, 199 Pomeroy Road, Parsippany, NJ, 07054 - Roof. On or about April 19, 2023, employees were engaged in snapping perimeter lines 4-feet from leading edge of flat roof on commercial building without utilizing fall protection. The employees were exposed to a fall of approximately 36 ft to the ground. The employer did not ensure each employee on a walking/working surface with an unprotected side or edge 6 feet (1.8 m) or more above a lower level was protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. b) At the facility, 199 Pomeroy Road, Parsippany, NJ, 07054 - Roof. On or about April 19, 2023, foreman was on the leading edge not utilizing fall protection system giving signals to the employee operating forklift lull to boom material to roof.
