29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) 620 Market Street Newark, NJ 07105 The employer did not administer a continuing effective hearing conservation program for each employee exposed at or above an 8-hour time-weighted average of 85 decibels. An employee (not provided 2020, 2021, and 2022 audiometric exam) in the warehouse operating machinery, performing screen cutting work was exposed to continuous noise up to 89.6% of the action level (AL) eight hour time-weighted average sound level of 85 dbA. The equivalent sound level of the measured dose is 89.2 dBA. Sampling was performed for 6 hours and 58 minutes on 06/07/2023, with the unsampled portion of time considered to represent zero for the exposure calculation. Violation occurred on or about June 7th, 2023.
