Text For Citation: 01 Item/Group: 001A Hazard:
29 CFR 1910.132(d)(1):The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: a. On or about April 4, 2023, the employer failed to assess workplace hazards which necessitate the use of PPE in the Bus Treads department area. Employees performing gluing activities were exposed to eye and skin injuries, and other serious health hazards, when handling the glue which contained hazardous chemical ingredients, such as but not limited to, Methyl Ethyl Ketone, Cyclohexane, and Cumene Hydroperoxide. These chemicals were corrosive to the eyes and skin, and presented chronic toxicity hazards to kidneys, liver, lungs, and central nervous system. b. On or about April 4, 2023, the employer failed to assess workplace hazards which necessitate the use of PPE in the Paint/Powder Coating department area. Employees performing painting activities were exposed to eye injuries, and other serious health hazards, when handling the powder paint which contained hazardous chemical ingredients, such as but not limited to, Barium Sulfate, Carbon Black, Polyethylene, and Amorphous Silixon Dioxide. These chemicals were corrosive to the eyes and were known or suspected carcinogens. c. On or about April 4, 2023, the employer failed to assess workplace hazards which necessitate the use of PPE in the forklift battery servicing area. Employees adding distilled water to electrical forklift batteries were exposed to eye and face injuries due to the corrosive splash hazard presented by the Sulfuric Acid in the lead-acid electric forklift batteries.
