Text For Citation: 01 Item/Group: 001A Hazard:
29 CFR 1928.51(d):Every employee who operates an agricultural tractor was not informed of operating practices contained in Appendix A of this part and of any other practices dictated by the work environment. Daybreak Foods, Inc. - West Mansfield, Ohio: On or about January 16, 2023, the employer did not ensure that employees who operated the John Deere tractor (model 4430; s/n 031064R) received annual training in safe operating procedures. Employees, preparing to drive the tractor, were exposed to being run over by the tractor in that the transmission was not put in neutral and parking brake set prior to dismounting, and the engine was not started from the seat of the tractor. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
