Text For Citation: 01 Item/Group: 001A Hazard:
29 CFR 1917.112(c)(3):The top surface of guardrails installed before October 3, 1983, shall be at least 36 inches (0.91 m) high. Those installed after October 3, 1983, shall be 42 inches (1.07 m), plus or minus 2 inches (5.1 cm), high. a) At the company's dock area of Sause Bros, located at 3710 NW Front Ave., Portland OR, on or about January 13, 2023 and at times prior there to, the height of the top-rail of the chain guardrail system on the Southeast edge of the dock, was less than 36 inches. An employee standing or walking near the edge could be expose to a fall of approximately 20 feet to the "floater's" metal deck below, suffering fractures, internal injuries or death, if the lean on the loose chain or slip or trip and fall over the defective chain railing system. b) At the company's dock area of Sause Bros, located at 3710 NW Front Ave., Portland OR, on or about January 13, 2023 and at times prior there to, the height of a section of the top-rail of the guardrail system of the southwest edge, made of a round metal pipe approximately 2 1/2 inch in diameter inside another pipe, was less than 36 inches. An employee standing or walking near the edge could be expose to a fall of approximately 20 feet to the "floater's" metal deck below, suffering fractures, internal injuries or death, if the lean on the loose chain or slip or trip and fall over the defective chain railing system.
