29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying hazards): a) Worksite - On or about January 4, 2023, employees performed sanitary sewer infrastructure work that involved excavation and underground pipe installation. A frequent inspection of the jobsite was not conducted by a competent person to identify present hazards related to this work. Among other methods, feasible and acceptable means of abatement include, but are not limited to: Follow CAT Operations and Maintenance Manual 336F and 340F Excavators - page 270 - Make sure no personnel are on the machine or near the machine in order to prevent any personal injury.
