OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by or caught-in hazards: (a) Cut, Bend, Form - Department 1 - The foot pedal, used to actuate the Chicago Dreis & Krump mechanical power press brake, model 265, serial number L-12354, employer machine number PB2, did not have protection to prevent unintended operation from falling or moving objects or by accidental stepping onto the pedal, exposing employees to the hazards of getting hands and fingers struck-by or caught-in the press brake point of operation, on or about October 28, 2022. (b) Cut, Bend, Form - Department 1 - The foot pedal, used to actuate the Niagara mechanical power press brake, employer machine number PB3, did not have protection to prevent unintended operation from falling or moving objects or by accidental stepping onto the pedal, exposing employees to the hazards of getting hands and fingers struck-by or caught-in the press brake point of operation, on or about October 28, 2022. (c) Cut, Bend, Form - Department 1 - The foot pedal, used to actuate the Chicago mechanical power press brake, serial number L7023, employer machine number PB4, did not have protection to prevent unintended operation from falling or moving objects or by accidental stepping onto the pedal, exposing employees to the hazards of getting hands and fingers struck-by or caught-in the press brake point of operation, on or about October 28, 2022. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
