29 CFR 1910.23(b)(9): 29 CFR 1910.23(b)(9): The employer did not ensure that ladders are inspected before initial use in each work shift, and more frequently as necessary, to identify any visible defects that could cause employee injury: The employer failed to establish and/or implement an inspection program for ladders used at the facility. On and at least several days prior to March 2, 2022, employees tasked with completing various maintenance activities at the site were not protected from fall hazards of approximately six (6) feet plus, when using the company's (Werner) portable step ladder. A visual inspection of the company's ladder showed that the ladder had a damaged spreader bar however, the defective equipment was not removed from service.
