29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): Location: 100 Military Ocean Terminal Street Bayonne, NJ 07002 - Shipyard paint cage a) The employer failed to implement their written hazard communication program for employees exposed to fire hazards while conducting spray painting and paint thinner mixing procedures using solvents with various flashpoints between 73.4 �F and 140 �F, while in close proximity to a live DeWalt 140,000 BTU Forced Air Kerosene Diesel Construction Heater. During the operation, the heater igniting flammable liquids/vapors resulting in a flash fire and employees sustaining second and third degree burn injuries. Condition noted on or about 12/27/2021.
