29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employees noise exposures equaled or exceeded an 8 hour Time Weighted Average (TWA) sound level of 85 dBA: (a) On or about 3/2/2022, an employee working in the block plant operating the block machine was exposed to continuous noise levels at 125.2% of the permissible daily noise exposure or an equivalent sound level of approximately 91.6 dBA (8-hour time-weighted average sound level of 85 dBA) during the 175 minute sampling period; exposure calculations included a zero increment for the 305 minutes not sampled. (b) On or about 3/2/2022, an employee working in the block plant operating a fork truck was exposed to continuous noise levels at 120.6% of the permissible daily noise exposure an equivalent sound level of approximately 91.4 dBA (8-hour time-weighted average sound level of 85dBA) during the 163 minute sampling period; exposure calculations included a zero increment for the 317 minutes not sampled. 1KB & MS LLC DBA Kingston Block & Masonry LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.95(c)(1), which was contained in OSHA inspection number 1234830 citation number 1, item number 1a and was affirmed as a final order on 06/14/2019, with respect to a workplace located at 1 Kiefer Lane Kingston, NY 12401.
