29 CFR 1910.134(e)(1) This standard is applicable to construction employment as defined by 1926.103. The employer is failing to protect employees from hazards that are associated with not fit testing employees while conducting residential masonry activities. This was most recently observed at 840 N. 14th St., Lincoln, NE 68568, on December 9th, 2021, where the employer mandates that employees work while wearing an N-95 Respirator even though the employee has not undergone a medical evaluation.
