29 CFR 1910.28(b)(7): The employer did not ensure that each employee on a walking-working surface near an opening, including one with a chute attached, where the inside bottom edge of the opening is less than 39 inches (99 cm) above that walking-working surface and the outside bottom edge of the opening is 4 feet (1.2 m) or more above a lower level is protected from falling by the use of one of the systems listed in 29 CFR 1910.28(b)(7)(i)-(iv): Jobsite located at the CT Transit terminal, 100 Leibert Road, Hartford, Connecticut: From September 20, 2021 to November 3, 2021, an employee was required to enter approximately twenty one VS roof mounted units to perform preventative maintenance. The employee was exposed to a fall distance of approximately nine feet from the catwalk/ledge into the duct system due to the open spaces between the interior catwalk and the edges of the opening leading into the duct system.
