29 CFR 1910.28(b)(3)(i):29 CFR 1910.28(b)(3)(i): The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D): On or about May 19, 2021, the employer failed to ensure that all floor openings were protected to prevent employees from stepping/falling through them. About or around Dock 4, while unloading an "Ocean Container" an employee stepped into a floor opening between the ocean container and the dock. The employee broke their ankle and later formed PE blood clots that caused the employee's death.
