29 CFR 1910.134(f)(2): The employer did not ensure that employees using tight fitting face piece respirators pass an appropriate qualitative or quantitative fit test prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter. (a) Wells Nursing Home, Inc. 201 West Madison Ave. Johnstown, N.Y.: On or about 9/01/2021 and thereafter, the employer did not provide a fit test to all employees provided with and required to wear an N-95 respirator. The employer required Registered Nurses, Certified Nursing Assistants, and Licensed Practical Nurses to wear an N-95 respirator while providing direct care to suspected and confirmed positive COVID-19 residents.
