29 CFR 1910.29(b)(1): The employer did not ensure that guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, that are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D-11 of this section). a) Line 4, Mixer Platform (left side) - On or about November 17, 2021, the employer did not ensure that the top edge height of the chain used as the top rail on the rear loading side of the platform was 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The lowest point of the chain was approximately 32 inches above the platform's walking-working surface, which exposed the effected employee to a fall hazard of approximately 6 feet. b) Line 4, Mixer Platform (right side) - On or about November 17, 2021, the employer did not ensure that the top edge height of the chain used as the top rail on the rear loading side of the platform was 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The lowest point of the chain was approximately 33 inches above the platform's walking-working surface, which exposed the effected employee to a fall hazard of approximately 6 feet.
