29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions: C.W. Contracting L.L.C., at 9140 Huron Street, Thornton, CO 80260: On July 30, 2021, the controlling employer did not ensure that adequate and effective daily inspections of an excavation were conducted by a competent person, in that a sub-contactor worked inside the excavation at a location that measured an estimated 9 feet deep without an adequate protective system in place. A spoils pile situated on the east side of the excavation was approximately 6 inches from the edge of the excavation. This condition exposed the sub-contractors to crushing and cave-in hazards.
