29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information on paragraph (d) of this section) before use(a): On or about June 9, 2021, at the location of 4719 NAVARRE RD. SW, Canton, OH 44706, the employer failed to correct deficiencies in equipment that were outside acceptable limits: a) The employer failed to correct deficiencies in the CTI, GG-NH3 ammonia monitors (SN's 000187405 - HTA, 000187404 - SC4, 000187403-Mezzanine, and 000187406 mezzanine) that were outside acceptable limits, before use. The monitors were installed and have been in use since September 2020 and required calibration March 2021. b) The employer failed to assure that the recently replaced CTI, GG-NH3 ammonia monitors were compatible with the existing engine room PLC (Allen Bradley - 1500) control panel that integrated the ventilation, ammonia monitors, and emergency shut off. The control panel was not operational. Employees were exposed to ammonia vapors and ammonia is a hazardous chemical that can cause respiratory irritation, unconsciousness, and death.
