29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite-specific procedures was not established and implemented for required respirator use: a) CLR Carthage Center LLC DBA Carthage Center, located at 1045 West Street, Carthage, NY: The employer did not implement its written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix). The employer required healthcare professionals, including but not limited to: Registered Nurses, Certified Nursing Assistants, Licensed Nursing Assistants, Physical Therapist, Occupational Therapist, Speech Therapist, Housekeeping and Maintenance Staff to wear respirators throughout their shifts while exposed to suspected or confirmed positive COVID-19 residents. The violation occurred on or about 1/15/2021 and after.
