Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: (a) On or about March 15, 2021, and at times prior, for the employees exposed to struck-by hazards where the explosion relief or venting door of the powdered sugar bag house detached, became a projectile, and struck the wall of the building on the third floor of the powdered sugar building at 7525 Red River Road in Wahpeton, North Dakota.
