Text For Citation: 01 Item/Group: 001A Hazard:
29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by tow rigging that was subjected to a force in excess of its breaking strength: a) On February 25, 2021, employees attempted to recover a 30,685 lbs. JCB load-all telescopic handler that was stuck in the mud. As a part of the rigging equipment, employees used two Laclede single hook 3/8 inch 43 grade tow chains, with a working load limit of 5,400 lbs. each. The employer had not provided training to their employees that would enable them to critically evaluate requirements for a heavy-duty winch-out. The employees failed to recognize the forces needed, and advanced rigging equipment and techniques needed to recover this equipment. Employees did not determine if the recovery equipment used had the capacity and working load limit(s) to safely accomplish the task. b) On February 25, 2021, employees attempted to recover a JCB load-all telescopic handler from the mud. The employees stood in the veer angle of rigging components that were under tension and were exposed to being struck by wire rope, tow chains, the snatch block and other rigging.
