Text For Citation: 01 Item/Group: 001A Hazard:
29 CFR 1910.147(c)(4)(ii)(C): Energy control procedure. The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following: Specific procedural steps for the placement, removal and transfer of lockout devices or tag-out devices and the responsibility for them. On or about February 11, 2021, the employer is failing to protect employees from struck-by and crush-by hazards due to the unexpected release of stored energy. The company's procedures did not include complete procedures to isolate the access to the truck's cab. The passenger side door which also allows access to the cab was not locked out. An employee was fatally injured while working under a Ready-mix concrete delivery truck that was not locked out to prevent the accidental release of stored energy. The truck rolled back and crushed the mechanic between the concrete floor and the axle wheel.
