OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that; employees were exposed to struck-by, crushing, and caught-in-between hazards: a. On or about January 26, 2021, at the above addressed work site, the employer did not ensure operators of the 4 x 4 Genie aerial lift, two employees performing tree trimming operations did not follow the manufacturer's recommendation regarding the safe operation of the equipment, thereby, exposing the workers to struck-by, crushing, and / or caught-in-between hazards, in the event the machine was to tip over.
