Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). a) On or about October 29, 2020 The employer did not ensure that each operator had successfully completed the training required by paragraph (l), prior to permitting an employee to operate a powered industrial truck. An employee was utilizing a Yale D54710 order picker without completing operator's training.
