29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) JBC Ent., Inc., at 3319 N Clayton Street, Denver, CO: On 11/25/2020 the employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to excavations to control or eliminate any hazards or other exposure to illness or injury. An employee used an excavator to tear down the concrete walls of an approximately twelve foot deep basement. Following this, the north wall and significant sections of the east and west walls were removed and unsupported vertical earth was exposed. An employee at the worksite had not received effective training regarding excavation hazards, including but not limited to cave-in or collapse hazards. This condition exposed the employee to an excavation hazard.
