29 CFR 1917.50(a):The employer used a material handling device listed in 29 CFR 1917.50(c) before ascertaining that the device had been certificated, as evidenced by current and valid documents attesting to compliance with the requirements in 29 CFR 1917.50(b). On or about November 24, 2020, the employer did not verify through written documentation that cargo handling equipment used to offload 1250 kg bags of sugar from vessels docked at the terminal had been certified by an accredited agency prior to use of the equipment exposing employees to potential struck-by hazards.
