29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Abingdon Care & Rehabilitation, 303 Rock Avenue, Green Brook, NJ 08812: On or about 4/27/2020 and thereafter, employees such as Registered Nurses, Licensed Practical Nurses and Certified Nursing Assistants were required to wear N95 respirators while providing direct nursing and care to patients suspected or confirmed as having COVID-19. The employer did not provide medical evaluations prior to requiring respirator use.
