Text For Citation: 01 Item/Group: 001A Hazard:
29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards: 1) On September 6, 2020, employees were struck by a grain elevator belt that fell as it was being hoisted. An eyebolt that was being used as part of the rigging was overloaded due to the configuration in which it was used. The eyebolt failed, which caused the grain elevator belt to fall and strike three employees. Two of the employees sustained injuries that required hospitalization. Among other feasible methods of abatement, one method is to ensure that adjustable hardware used in rigging equipment for hoisting meets the requirements of ASME B30.26-2015- Rigging Hardware, and to ensure that employees designated as riggers are trained in the selection, inspection, cautions to personnel, effects of environment, and rigging practices as covered by ASME B30.26-2015.
