29 CFR 1910.134(a)(2): A respirator was not provided by the employer to each employee when such equipment was necessary to protect the health of the employee: Facility at 305A Maple Street, East Longmeadow, MA: On and before May 18, 2020, some employees who provided direct care to COVID-19 positive residents were not provided respiratory protection and were exposed to the SARS-CoV-2 virus. Minimum appropriate respiratory protection is an N95 filtering facepiece. The employees were required to be within six feet of residents that were not wearing face coverings in order to perform tasks such as feeding, washing, dressing and other personal care.
