29 CFR 1910.134(e)(1): The employer did not provide medical evaluations to determine the employees ability to use a respirator, before the employees were fit tested or required to use respirators in the workplace: a) On or about 3/28/2020 and after, employees such as certified nursing assistants working at Cranbury Center, located at 292 Applegarth Road in Monroe Township, NJ, were required to wear N95 respirators during direct nursing and personal care of patients suspected or confirmed as having COVID-19. The employer did not provide medical evaluations prior to requiring respirator use.
