29 CFR 1910.134(d)(1)(ii): The employer did not select and use a NIOSH-certified respirator in compliance with the conditions of its certification: a) Hamilton 2 and Madison 2: The employer did not provide a NIOSH-certified respirator to a Nurse Minimum Data Set Coordinator who was required to work with confirmed and suspect COVID-19 residents. The Nurse Minimum Data Set Coordinator was provided with a respirator labeled "KN95" which was not NIOSH certified. The violation occurred on or about 4/6/2020 and after. b) Hamilton 2 and Madison 2: The employer did not provide a NIOSH-certified respirator to a Licensed Practical Nurse, who was required to work with confirmed and suspect COVID-19 residents. The Licensed Practical Nurse was provided with a respirator labeled "KN95" which was not NIOSH certified. The violation occurred on or about 4/6/2020 and after. c) Hamilton 2 and Madison 2: The employer did not provide a NIOSH-certified respirator to a Unit Manager, who was required to work with confirmed and suspect COVID-19 residents. The Unit Manager, was provided with a respirator labeled "KN95" which was not NIOSH certified. The violation occurred on or about 4/6/2020 and after. d) Hamilton 2 and Madison 2: The employer did not provide a NIOSH-certified respirator to an Assistant Director of Nursing who was required to work with confirmed and suspect COVID-19 residents. The Assistant Director of Nursing was provided with a respirator labeled "KN95" which was not NIOSH certified. The violation occurred on or about 4/6/2020 and after. e) Hamilton 2 and Madison 2: The employer did not provide NIOSH-certified respirators to Certified Nursing Assistants who were required to work with confirmed and suspected COVID-19 residents. Certified Nursing Assistants (CNA) were provided with respirators labeled "KN95" and "N95" which were not NIOSH certified. The employer required all Certified Nursing Assistants to wear respirators throughout their shifts at work. The violation occurred on or about 4/6/2020 and after.
