29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a. CareOne at the Highlands, 1350 Inman Ave, Edison, NJ On or about April 16, 2020 and thereafter, during the first pandemic surge which necessitated employees at the workplace, such as Registered Nurses (RNs),Licensed Practical Nurses (LPNs), and Certified Nurses Assistants (CNAs),to wear N95s for the first time, the employer did not ensure that medical evaluations were fully compliant and documented for those employees. Violation occurred on or about April 16, 2020, and continuing thereafter.
