29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a) Community First Healthcare of Illinois, Inc. located at 5645 W. Addison Street, Chicago, IL, 60634: On or about June 9, 2020, the employer did not develop and implement a complete written respiratory protection program that included all provisions in 29 CFR 1910.134(c)(1)(i) ? (ix). The employer?s program failed to address use of respirators that may be brought into the workplace by employees and use of respirators with patients suspected or confirmed to have COVID-19. Employees in the Intensive Care Unit (ICU) 5N/5S wore Cardinal Health N95s, Gerson 2140 N95s, Halyard N95s, and elastomeric half-facepiece respirators throughout their work shifts while caring for patients suspected or confirmed to have COVID-19. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
