29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) At the facility, 2305 Rancocas Road in Burlington, NJ - The Employer provided and required the use of respirators at the facility. The employer did not ensure that housekeeping employee(s) that were provided with and required to wear approved respirators were provided with a medical evaluation prior to their use of respirators, on or about 4/6/2020 and after. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
