29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: Location: In the Facility On or about April 4th, 2020, respiratory protection including, but not limited to N95 Filtering Face Piece Respirators or higher, was required to protect employees while administering any aerosolized creating treatments, conducting NP swabs, or entering the room of a patient showing signs and symptoms of a pandemic influenza virus where medical evaluations were not provided.
