29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) VA New Jersey Healthcare System, 151 Knollcroft Rd, Lyons, NJ: Community Living Center, housekeeping department: The agency failed to provide medical evaluations for employees who were required to wear N95 respirators. The agency required housekeeping employees to wear N95 respirators, while collecting trash and soiled linen and cleaning and disinfecting rooms of residents/patients with suspected or confirmed cases of COVID-19. Violation occurred on about 04/9/2020 and thereafter.
