29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee�s ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) At the facility, COVID-19 Patient Isolation Wing - On or about May 2, 2020 and thereafter, the employer did not provide a medical evaluation for the nurses and other staff employees who were required to wear N95 respirators for protection against the hazard of the COVID-19 virus while treating and caring for COVID-19 positive patients.
