29 CFR 1910.134(f)(2): The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter. (a) On or about May 6, 2020, and continuing thereafter, at the Center for Ambulatory Surgery: Employees working as Registered Nurses were required to wear N95 filtering facepiece respirators while providing direct patient care to COVID-19 positive patients. The employer did not ensure the employees received annual fit tests that expired prior to March 2020. (b) On or about May 6, 2020, and continuing thereafter, at the Center for Ambulatory Surgery: Employees working as Registered Nurses were required to wear N95 filtering facepiece respirators while providing direct patient care to COVID-19 positive patients. The employer did not ensure that these employees were provided additional fit tests when different makes/models of N95 filtering facepiece respirators were used.
