29 CFR 1910.266(d)(6)(iii): Each employee performing a logging operation at a logging work site shall work in a position or location that is within visual or audible contact with another employee. a) Millcreek Lumber, LLC, at a woodlot located adjacent to 6430 Township Highway 235: On and/or preceding April 23, 2020, the employer did not ensure each employee that was performing a logging operation was within visual or audible contact with another employee. On April 22, 2020, the victim was felling trees with no other employees within visual or audible contact when a tree struck the victim, resulting in the victim's death.
